pepsico was sued by two men in wisconsin because they claim that pespico stole their idea for a drink (the bottled water aquafina). the dudes won more than they were asking for ($75K) and were awarded $1.26B bones because pepsico never responded to the lawsuit.
they’re asking that the lawsuit be thrown out and they’ve identified two main reasons why they didn’t respond. here they are:
- it was served in north carolina where it’s incoporated but not based (it’s based in new york).
- one of their secretary’s took too long to respond to letters associated with the case.
they claim that the secretary, kathy hines who works for some dude in the legal department, was soooo busy preparing for the board meeting that she forgot to tell her boss about the first lawsuit notification and didn’t remember it until she got a second notification some time later.
call me crazy, but i think the idea that ms. hines forgot to perform one of her most basic duties. i mean, if office manager joan holloway could make a tourniquet, plan a party, screw her boss, find a husband, manage office politics, organize offices, and practice songs on the accordion, don’t you think hines could manage to show a letter about a lawsuit to a lawyer?
